If you or your business provided healthcare services, equipment, or supplies to Blue Plan Patients anytime from July 24, 2008 – October 4, 2024, you may be eligible.
Additionally, the settlement class is divided into two groups:
1) 92% of the net settlement fund will be allocated to healthcare facilities. This portion of the fund will be distributed to healthcare systems who submit claims on behalf of healthcare facilities and individual healthcare facilities.
2) 8% of the net settlement fund will be allocated to healthcare professionals. This will be distributed to medical groups and organizations who submit claims on behalf of their medical professionals, as well as individual medical professionals.
Since the claims administrator and the Settling BCBS Defendants will likely be missing or have incomplete data, you can file a claim in one of two ways:
1. Default method: This means you use the data from the administrator to calculate your claim value. (Some facility claimants may not be eligible for this method. See the list below*.)
2. Alternative method: This means you submit documentation to provide the value of your claim. (This method is not available to the healthcare professionals subclass.
The alternative method is the best way for most claimants to maximize their recovery. CCC can help with that.
For the default method, the claims administrator will extrapolate allowed amounts for 2015-2024 using growth in national hospital expenditures.
For the alternative method, allowed amounts will be calculated based on claimant-submitted data.
With the alternative method, you can still maximize your claim even if you only submit allowed amounts for some of the eligible years. The claims administrator will use the Consumer Price Index for hospital and related services to both backcast the allowed amounts for years prior to the available data and forecast amounts for the later years.
Claimants must submit their National Provider Identifier (NPI) or Taxpayer Identification Number (TIN) for any business that worked with BCBS. It’s also recommended to know the timeframe for each NPI/TIN submitting a claim. And if you're using the alternative method, documentation for historical billing is recommended.
